1. About Lady M Latex

2. Application

These terms apply to consumer orders placed through this website. Mandatory consumer rights under the law of the customer’s country of residence remain unaffected.

3. Products and offers

Product pages describe the principal characteristics, latex thickness and material, size or made-to-measure status, colour options, price including applicable VAT, expected production time and delivery information. Because latex items are handmade, minor non-material variations may occur.

4. Contract and payment

A contract is formed when Lady M Latex accepts the order and sends an order confirmation. Payments are processed securely through Mollie using the methods displayed at checkout. Lady M Latex may refuse or cancel an order when information is incorrect, payment is not completed, production is not reasonably possible or fraud is suspected. Any payment received for a cancelled order will be refunded.

5. Standard and made-to-measure products

A standard product is supplied in an offered standard size and specification. A made-to-measure or personalised product is manufactured according to measurements or other individual specifications supplied or approved by the customer. Customers are responsible for providing accurate measurements and approving specifications before production begins.

6. Hygiene seal and withdrawal

Standard items that are unsuitable for return for health protection or hygiene reasons are supplied with a clearly identifiable hygiene seal. The statutory 14-day right of withdrawal applies while that seal remains intact. The right of withdrawal ends when the customer breaks the seal. Products made to the customer’s specifications are excluded from the statutory right of withdrawal. These exclusions do not affect rights relating to faulty, damaged or incorrectly supplied products.

7. Delivery

Orders are shipped with PostNL or a delivery partner shown at checkout. Production and delivery estimates are not guaranteed dates unless expressly agreed. Import duties, taxes and customs charges outside the European Union are the customer’s responsibility unless checkout states otherwise.

8. Conformity and complaints

Products must conform to the contract and customers retain all statutory warranty rights. A complaint should be sent promptly to info@lady-m-latex.shop with the order number, description and photographs where useful. Lady M Latex will provide an appropriate remedy, such as repair, replacement, price reduction or refund, in accordance with applicable law.

9. Liability

Nothing in these terms excludes liability that cannot legally be excluded. Lady M Latex is not responsible for damage caused by incorrect measurements supplied by the customer, misuse, incorrect dressing, unsuitable lubricants, oils, solvents, excessive heat, sharp objects or failure to follow care instructions.

10. Intellectual property

Website content, product designs, photographs and branding may not be copied or commercially used without written permission, except where permitted by law.

11. Governing law and disputes

Dutch law applies, without depriving an EU consumer of mandatory protections in their country of residence. Please contact Lady M Latex first so a complaint can be resolved directly. Consumers may also use a competent alternative dispute body or court where applicable.
